A challenging Meeting !

The day of March 9, 2018, was for many, the beginning of ICANN 61 with several events and preparatory meetings. This was the first of the three statutory meetings to be held in 2018 and was de facto the one to further engage the community in ICANN’s discussions, as its name suggests: “Community Forum“. Aside from the Puerto Rico feverish tunes of Salsa ringing everywhere, it was busy, animated with stormy discussions, but ended in good conditions. The next meetings of the year will take place respectively in Panama for policy discussions, and in Barcelona for the annual General Assembly.

ICANN 61 was my fourth participation in an ICANN meeting after Durban (ICANN 47), Marrakech (ICANN 55) and Johannesburg (ICANN 59). This is also where I had the opportunity to attend a public meeting for the first time between board members and the community: it was a very good experience and it represents an example of transparency within the ecosystem.

From the outset, ICANN 61 has been one of the busiest meeting in recent years. If one could sometimes note that the waiting hall and booths were empty, it was simply because the participants were this time more interested and concerned in the working groups, trainings and various meetings. In addition to appointment issues or the open meeting regarding the operation of the NomCom. Other occurrences which marked this meeting were the security vulnerability of Adobe Connect and the inventive alternative solutions. On the policy front, discussions about the next-gen WHOIS protocol and meetings on the DNS strategy of Africa, the advent of the GDPR, whose enforcement is scheduled for May 2018, is the one that has most heated this meeting. To reassure the various stakeholders with controversial views on its mandate and the actions taken so far, ICANN.org has had to organize many seminars and public meetings to show its willingness to comply with data privacy rules stemming from this new institutional framework. As a representative of the Non-Commercial User Constituency (NCUC) to the Non-Commercial Stakeholder Group (NCSG) Policy Committee, I followed closely our discussions on this issue, which resulted in a signed letter from Dr. Farzaneh Badii (NCSG Chair) to ICANN on choices regarding the GDPR compliance models. This letter addressed three crucial points:

1. The difference between natural person and legal person
2. The WHOIS “Thick” which is an extension of the data collection fields as opposed to the publicly accessible “Thin” WHOIS.
3. Tiered access models

As far as I was concerned, my pre-ICANN meetings were weighted by my participation in two different workshops.

In a first step, as a member of the group working on the policy development process for the Next-Gen Registration Directory Services (“Next-Gen RDS PDP”) and a co-rapporteur of the sub-working group on compliance and regulatory issues, I participated in the F2F meetings of the working group not only to outline the work of my subgroup but also to follow the discussions in order to deduce the strong actions that can be taken within the NCUC to continue accomplishing our mission. What is most important now is that all the principles and motivations mentioned by the various sub-groups to justify the collection and / or processing of personal data remain only in the universe of possible proposals at the moment. These proposals will be further validated during a final deliberation aimed at seeking a global consensus on the fundamental elements that will form the basis of the next-generation directory. However, it should be noted that many NCUC members such as Kathy Kleiman and Stephanie Perrin disagreed with the current approach of the working group leadership to address this issue. For K. Kleiman, it is a distraction to focus on data collection arguments based on regulatory and law purposes when ICANN is neither a law enforcement authority nor a regulatory agency. This certainly represents a waste of time that Stephanie Perrin stated in the many factors that unnecessarily slow down the progress of this working group.

In a second step, and as the main reason for my fellowship in Puerto Rico, I participated in a training organized conjointly by ICANN and NCUC on Policy writing and Public Comment Writing in specific. The main purpose of this training was to build the capacity of our members in this domain and to harmonize the writing styles in order to develop a synergy that will improve the drafting process of our future public comments. The trainer, Jim Trengove, former staff of ICANN, delivered a high-quality training through a practical methodology based on concrete examples. In just two days of training, all participants were able to distinguish between the good points that make a relevant comment and the things to avoid. All in all, the training was a great success, and all participants acknowledged that it was a successful program. The participants (both online and in person) were very dedicated, the massive interaction of participants on our twitter account has also testified. We will remember that more than a dozen of members gained more knowledge about the development of policies and the writing of public comments. Their role now is to share this knowledge within the community and, in the future, to help write public comments in a more effective way.

Beside these two important focus of my participation in ICANN 61, I attended several NCSG, NCUC and NPOC activities as well as various meetings of other stakeholders within ICANN during the rest of my stay in San Juan. These included the NCUC “Constituency Day”, the monthly meeting of the NCSG Policy Committee, and the NPOC-NCUC joint meetings. During the “Constituency Day”, I had the opportunity as a fellow to express my gratitude to the leadership team who offered me this grant. I then committed to producing, together with the other members of the NCSG Policy Committee, a template that will serve as a basis for writing our public comments. The participants welcomed this decision and many promised to collaborate on this work, which among other things received the approval of the chairman of the committee, Rafik Dammak. Moreover, I also had the opportunity to present the state of progress  of ICANN GNSO Working Group on the Policy Development Process of the Next-Generation WHOIS. Basically, it will be for the NCUC members to ensure that the conclusions of this report do not give ICANN any more rights than it should be in order to ensure that it does not deviate from its main mission which is the security and stability of the Internet infrastructures. In summary, my participation in the ICANN 61 community meeting was very successful: I learned a lot, I felt more involved and more helpful. The Public Comment writing training represents an important input to my role on the NCSG Policy Committee. In regard of the quality of this training, no one opposed the organization of future modules. On a separate note, it should be noted that the good involvement of our various experts namely Stephanie Perrin, Mueller Milton, Ayden Ferdeline, Farzaneh Badii, to name a few, was crucial to mark our position in relation to the actions of ICANN regarding the GDPR. I could note the presence of a great cohesion and a good team spirit, witnesses of our strength to face more fights.

Une réunion communautaire mouvementée !

La journée du 9 mars 2018 a marqué, pour beaucoup, le début de ICANN 61 avec plusieurs évènements et réunions préparatoires de groupes restreints. Ce fut la première des trois réunions statutaires de l’année 2018 et elle constituait de facto celle visant à plus engager la communauté dans les discussions de ICANN, comme son nom l’indique en anglais : “Community Forum”.  Mis à part les soirées fiévreuses aux ambiances Salsa, elle a été chargée, animée de discussions houleuses, mais s’est terminée dans de bonnes conditions. Les prochaines réunions de l’année auront respectivement lieu au Panama sur les discussions politiques, et à Barcelone pour l’Assemblée Générale annuelle.

 

ICANN 61 constituait ma quatrième participation à une réunion de ICANN après Durban (ICANN 47), Marrakech (ICANN 55) et Johannesbourg (ICANN 59). C’est aussi là que j’ai eu l’occasion d’assister pour la première fois à une réunion publique entre les membres du conseil ou “board” et la communauté : ce fut une très une bonne expérience et cela représente un exemple de transparence dans l’écosystème.

D’entrée de jeu, on pouvait constater que cette réunion  a été l’une des réunions les plus chargées de ces dernières années. Si on notait parfois que les hall d’attente et les stands étaient vides, c’était simplement parce que les participants ont été cette fois-ci plus intéressés et préoccupés dans les groupes de travail, les formations et réunions diverses. A côté des problèmes de nomination ou de fonctionnement du NomCom, de la faille de sécurité d’Adobe Connect, des discussions concernant la prochaine génération du protocole WHOIS et des réunions sur la stratégie DNS de l’Afrique, l’avènement du GDPR dont l’entrée en vigueur est prévue au mois de mai 2018 est celui qui a le plus marqué cette rencontre. Pour rassurer les différentes parties prenantes aux avis jusque là controversés sur sa position et les dispositions qu’elle fait prendre, ICANN.org a dû organiser beaucoup de séminaires et réunions publiques pour montrer sa bonne volonté à se mettre en conformité vis-à-vis des règles de protection de la privée découlant de ce nouveau cadre institutionnel. En tant que représentant de la circonscription des utilisateurs à but non commercial (NCUC) au sein du Comité d’Orientation des politiques (“Policy Committee”) du groupe des parties prenantes à but non commercial (NCSG) j’ai suivi de près les discussions de notre groupe sur cette question, lesquelles ont abouti à une lettre signée du Dr Farzaneh Badii (chair du NCSG) à ICANN sur ses choix concernant les modèles de conformité du GDPR. Cette lettre a abordé trois points cruciaux à savoir :

1. La différence entre personne naturelle en tant qu’individu et personne légale
2. Le “Thick” WHOIS qui consiste en une extension des champs de collecte de données par opposition au “Thin” WHOIS accessible au public.
3. Les modèles d’accès hiérarchisés

Pour ma part, mon séjour pré-ICANN a été pondéré par ma participation à deux différents ateliers.

Dans un premier temps, en tant que membre du groupe travaillant sur le processus de développement de politiques sur la prochaine génération des services d’annuaire d’enregistrement des noms de domaine (“Next-Gen Registration Directory Services” en anglais) et co-rapporteur du sous-groupe de travail sur les questions d’obligation contractuelle et/ou de régulation, j’ai participé aux rencontres F2F du groupe de travail non seulement pour exposer le travail de mon sous-groupe mais aussi pour suivre les discussions et en déduire les actions fortes qui peuvent être prises au sein du NCUC pour continuer d’accomplir notre mission. Ce qu’il faut retenir à présent est que tous les principes et motivations évoqués par les différents sous-groupes pour justifier la collecte et ou le traitement des données à caractère personnel ne restent que des propositions possibles à l’heure actuelle. Ces propositions seront encore soumises à l’épreuve d’une délibération finale visant à chercher un consensus global sur les éléments fondamentaux qui feront la base de l’annuaire de prochaine génération. Toutefois, il faudra relever que beaucoup de membres du NCUC telles que Kathy Kleiman et Stéphanie Perrin ont désapprouvé la tournure actuelle que prend le groupe de travail pour approcher ce problème. Pour K. Kleiman, c’est une distraction que de vouloir se focaliser sur des arguments de collecte de données basés sur des motifs de régulation et d’obligation de loi lorsque ICANN n’est ni une autorité de loi ni une agence de régulation. Cela représente à coup sûr une perte de temps que Stéphanie Perrin englobe dans les multiples facteurs qui ralentissent inutilement la progression de ce groupe de travail.

Dans un second temps, et comme raison principale de mon fellowship à Puerto Rico, j’ai participé à la formation sur la rédaction de politiques et de commentaires publiques au sein de ICANN, organisée conjointement par ICANN et la NCUC. Le but essentiel de cette formation a été de renforcer les capacités de nos membres dans ce domaine et d’harmoniser les styles de rédaction afin de développer une synergie qui améliorera les processus de rédaction de nos futurs commentaires publics. Le formateur Jim Trengove, ancien personnel de ICANN, a délivré une formation de qualité à travers une méthodologie pratique se basant des exemples concrets. En seulement deux jours de formation, tous les participants étaient capables de dénombrer les bons points qui font un commentaire pertinent et les choses à éviter pour ne pas désintéresser le lecteur. Somme toute, la formation a été un grand succès, et tous les participants en sont unanimes. L’engagement a été fort, l’interaction massive des participants sur notre compte twitter en a d’ailleurs témoigné. Nous retiendrons que plus d’une dizaine de membres sont désormais aguerris pour l’élaboration de politiques et la rédaction de commentaires publics. Leur rôle à présent est de partager cette connaissance au sein de la communauté et, à l’avenir d’aider à la rédaction de commentaires publics d’une façon plus efficace.

A côté de ces deux focus importants de ma participation à ICANN 61, j’ai durant le reste de mon séjour à San Juan assisté à plusieurs activités du NCSG, NCUC et du NPOC ainsi qu’à diverses réunions des autres parties prenantes au sein de ICANN. Il s’agissait notamment de la “journée porte ouverte” de la NCUC, la réunion mensuelle du Comité d’Orientation des politiques du NCSG, et des réunions conjointes NPOC-NCUC. Pendant la “journée porte ouverte”, j’ai eu l’occasion en tant que fellow d’exprimer ma gratitude auprès du leadership qui m’a offert cette opportunité. Je me suis alors engagé à produire, de concert avec les autres membres du Comité d’Orientation du NCSG, un modèle de document qui servira de base pour la rédaction de nos commentaires publics. Les participants ont bien accueilli cette nouvelle et beaucoup ont promis collaborer sur ce travail qui a entre autre reçu l’aval du président du comité, Rafik Dammak.. Par ailleurs, j’ai également eu la possibilité de présenter l’évolution des travaux au sein du groupe de travail sur le processus de développement des politiques de la prochaine génération du WHOIS. En gros, il s’agira pour les membres de la NCUC de veiller à ce que les conclusions de ce rapport ne donnent pas plus de droit à ICANN qu’elle ne devrait avoir de sorte à ce qu’elle ne s’écarte trop de sa mission principale qui est la sécurité et la stabilité des infrastructures de l’Internet. En résumé, ma participation à la réunion communautaire de ICANN 61 a été très fructueuse : J’ai beaucoup appris, je me suis senti plus impliqué et plus utile. La formation sur la rédaction des commentaires publics représente un intrant de taille pour l’accomplissement de mes tâches au sein du Comité d’Orientation des politiques du NCSG. D’ailleurs, à l’évidence de la qualité de cette formation, nul ne s’est opposé à l’organisation de futurs modules. Pour finir, il faut noter que la bonne implication de nos différents experts à savoir Stéphanie Perrin, Mueller Milton, Ayden Ferdeline, Farzaneh Badii, pour ne citer que ceux-là, a été déterminante pour marquer notre position par rapport aux actions de ICANN en ce qui concerne le GDPR. J’ai pu noter la présence d’une grande cohésion et d’un bon esprit d’équipe, témoins de notre force pour affronter plus de combats.
